SHORT-TERM HOLIDAY RENTAL AGREEMENT AND HOUSE RULES
THE PARTIES
This Short-Term Holiday Rental Agreement and House Rules (“Agreement”) is made on {{reservation_date}} between:

The Guest and Host agree to the following terms and conditions regarding the temporary rental of the holiday accommodation described below.
This Agreement forms part of the Host’s rental terms and conditions applicable to the reservation.
ACCEPTANCE THROUGH BOOKING PROCESS
The Guest acknowledges that this Agreement, the cancellation policy and the house rules were made available before completing the reservation.
By completing the booking process and proceeding with payment, the Guest confirms acceptance of these terms and agrees that they form an integral part of the rental agreement.
The Guest acknowledges that the accommodation is made available based on the booking details, payment obligations and acceptance of these terms.
For direct bookings, acceptance may be provided electronically, including by completing the online booking process, confirming the reservation by email or making payment for the reservation.
VERSION OF AGREEMENT
The version of this Agreement applicable to the reservation is the version accepted by the Guest at the time of booking.
The Host may update its general rental terms and conditions for future reservations. The version accepted by the Guest at the time of booking remains applicable to that reservation.
In case of any conflict between the Booking Confirmation, this Agreement, and the House Rules, the provisions of this Agreement shall prevail, unless explicitly agreed otherwise in writing.
FORMATION OF AGREEMENT
The rental agreement between the Host and Guest is concluded when the Guest completes the booking process and receives a booking confirmation from the Host.
The booking confirmation, together with this Agreement, the applicable cancellation policy and the house rules, forms the complete agreement between the Host and Guest.
ENTIRE AGREEMENT
This Agreement, together with the booking confirmation, applicable cancellation policy and house rules, constitutes the entire agreement between the Host and Guest regarding the rental of the accommodation.
Any amendments or additional agreements must be confirmed in writing by the Host.
THE ACCOMMODATION
The Host agrees to provide the following holiday accommodation to the Guest:

The accommodation is rented exclusively for temporary recreational holiday purposes for the agreed rental period.
The Guest acknowledges that the accommodation is provided strictly as short-term holiday accommodation and not as a primary residence. This Agreement does not create a residential tenancy agreement, nor does it grant any right of permanent occupancy or tenancy protection under applicable residential tenancy laws (including Article 7:232 paragraph 2 of the Dutch Civil Code). The Guest confirms and warrants that their primary residence remains elsewhere and that they maintain their principal registration at their home address.
The Guest acknowledges that the accommodation description, photographs, and information provided by the Host are intended to give a fair and accurate impression of the accommodation. The Guest understands that minor differences may occur due to maintenance, seasonal changes, availability of facilities, replacement of equipment, or circumstances beyond the Host’s reasonable control. Such minor differences do not constitute a breach of this Agreement.
The Guest acknowledges that this accommodation is a private holiday rental and not a hotel. Unless explicitly stated otherwise, hotel services such as reception services, daily cleaning, room service, or other hotel-related services are not included.
The Guest acknowledges that facilities, equipment, and furnishings may occasionally be replaced, repaired, maintained, or updated. The Host will make reasonable efforts to maintain comparable quality but cannot guarantee the availability of specific brands, models, or individual items. The Host cannot guarantee specific views, weather conditions, surroundings, wildlife, noise-free conditions, or external circumstances that are outside the Host’s reasonable control.
SURROUNDINGS AND EXTERNAL CONDITIONS
The Guest acknowledges that the accommodation is located in a natural, residential, or holiday park environment.
The Guest understands that external circumstances beyond the Host’s direct control may occur, including but not limited to actions of neighbours or other guests, park or municipal activities, scheduled or emergency third-party maintenance, weather conditions, local wildlife, traffic, or other environmental factors.
The Host will make reasonable efforts to inform the Guest in advance of any major external disturbance or maintenance work known to the Host prior to arrival. However, the Host cannot guarantee the complete absence of noise or external influences beyond the Host’s reasonable control. Such circumstances do not automatically constitute a breach of this Agreement, nor do they entitle the Guest to compensation, rent reduction, or early termination, except where explicitly required by mandatory law.
RENTAL PERIOD
The Guest is entitled to use the accommodation from:

The Guest must leave the accommodation no later than the agreed check-out time. Early check-in or late check-out is strictly subject to prior written approval from the Host.
If the Guest fails to vacate the accommodation by the agreed check-out time without prior written consent from the Host, the Guest shall be liable to pay a contractual penalty of €100.00 for each hour (or part thereof) that the check-out is delayed. In addition to this penalty, the Guest shall be fully liable for any additional costs and direct damages incurred by the Host as a result of the unauthorized late check-out, including but not limited to additional cleaning fees, emergency staff charges, and relocation costs or compensation owed to incoming guests.
NUMBER OF GUESTS
The accommodation may only be occupied by the specified number of guests stated in the reservation:

The maximum permitted occupancy must not be exceeded at any time due to safety, insurance, local municipal licensing, and legal requirements.
The Guest may not allow additional persons to stay overnight without prior written consent from the Host. The Guest may not invite external visitors to organize gatherings, parties, or events without prior written permission from the Host.
If the maximum permitted occupancy is exceeded, or if unauthorized visitors are present without consent, the Host reserves the right to:
Immediately charge a fine of €100.00 per unauthorized person per night/day; and/or
Require unauthorized persons to leave the premises immediately; and/or
Terminate this Agreement with immediate effect without prior notice and require all guests to vacate the accommodation immediately, without any right to a refund or compensation for the remaining rental period.
The Guest making the reservation remains fully responsible for ensuring that all persons staying at or visiting the accommodation comply with this Agreement and the house rules. The Guest confirms that all persons under the age of 18 staying at the accommodation are accompanied and supervised at all times by a responsible adult.
RESERVATION HOLDER, VERIFICATION AND SUBLETTING
The person making the reservation must be one of the persons staying at the accommodation.
Reservations may not be transferred, assigned or given to another person without prior written approval from the Host.
The Guest does not have the right to sublet, transfer, assign or otherwise make the accommodation available to third parties without prior written approval from the Host.
The Guest remains responsible for all persons entering or staying at the accommodation under the reservation.
The Guest confirms that all information provided during the booking process is complete and accurate, including:
guest name;
contact details;
number of guests;
requested stay dates;
any other information required for the reservation.
The Guest is responsible for ensuring that all booking information remains accurate.
Providing incorrect or incomplete information may result in cancellation of the reservation, refusal of access or termination of the stay where reasonably necessary.
The Host may request identification information where reasonably necessary for:
reservation verification;
legal obligations;
fraud prevention;
municipal registration requirements.
The Guest understands that providing requested information may be required to complete the reservation.
The Host will only request information that is reasonably necessary for these purposes and will process such information in accordance with applicable privacy legislation.
The Host reserves the right to refuse or cancel reservations where identity verification cannot reasonably be completed.
The Host also reserves the right to refuse or cancel reservations where there are reasonable grounds to believe that the accommodation may not be used in accordance with this Agreement, the house rules or applicable law.
Where reasonably possible, the Host will inform the Guest of the reason for such refusal or cancellation.
PAYMENT
The Guest agrees to pay the total amount shown during the booking process, including applicable:
rental fees;
cleaning fees;
tourist taxes;
additional agreed charges.
Payments must be made using the payment method provided by the Host or selected during the booking process.
Until the required payment obligations have been fulfilled, the reservation may be considered provisional.
A reservation is confirmed after completion of the required payment obligations according to the applicable payment terms.
Any outstanding payments must be settled according to the payment terms communicated during the booking process.
If payment is not received within the agreed payment period, the Host may cancel the reservation and release the accommodation without further obligation to the Guest.
The Host is entitled to make the accommodation available for other guests after cancellation.
Any amounts already due under this Agreement remain payable by the Guest.
The Guest remains liable for all amounts due under this Agreement, regardless of whether the Guest continues or completes the stay.
The Host reserves the right to offset any undisputed amounts owed by the Guest against any refund or payment otherwise due to the Guest, where permitted by applicable law.
CANCELLATION POLICY
The Guest acknowledges that cancellation conditions are an essential part of this Agreement because the accommodation is reserved exclusively for the Guest for a specific period and cannot generally be sold as a standard product after cancellation.
The Guest has the right to cancel the reservation free of charge within 24 hours after completing the booking process, provided that the cancellation request is received more than 28 days before the scheduled arrival date.
After this period, the applicable cancellation policy applies as communicated during the booking process and confirmed with the reservation.
Cancellation more than 28 days before the scheduled arrival date:
The Guest may cancel free of charge unless a different cancellation policy was clearly accepted during the booking process.
Cancellation within 28 days before the scheduled arrival date:
The Guest acknowledges that cancellation shortly before arrival may cause financial loss to the Host because the accommodation has been reserved exclusively for the Guest and the opportunity to accept other bookings may be limited.
The Guest remains liable for the applicable cancellation amount stated during the booking process.
The cancellation amount reflects the reasonable financial consequences of late cancellation, including:
loss of booking opportunity;
reserved availability;
preparation and administrative costs;
reasonable costs incurred by the Host.
The cancellation amount is not intended as a penalty but represents the agreed allocation of financial risk between Host and Guest.
The Host will make reasonable efforts to reduce any loss resulting from cancellation by attempting to re-rent the accommodation where reasonably possible.
If the accommodation is successfully re-rented for the same period, the Host may take the recovered rental income into account when determining any remaining amount due, taking into account differences in rental price and reasonable administrative costs.
The cancellation date is the date on which the written cancellation request is received by the Host.
NO-SHOW AND EARLY DEPARTURE
If the Guest does not arrive on the agreed check-in date without prior notification, the reservation will be considered cancelled.
In case of a no-show, the Guest remains liable for the applicable cancellation amount according to this Agreement and the accepted cancellation policy.
If the Guest chooses to leave the accommodation before the agreed departure date, no refund will be provided for the unused part of the stay unless mandatory law requires otherwise.
COMPLAINTS AND ISSUES DURING THE STAY
The Guest agrees to notify the Host as soon as reasonably possible of any complaint, defect, damage or issue affecting the accommodation or the stay.
The Guest acknowledges that timely notification gives the Host a reasonable opportunity to investigate the issue and, where possible, provide an appropriate solution.
The Guest cannot claim compensation for issues that could reasonably have been prevented, limited or resolved if reported promptly during the stay.
The Host will make reasonable efforts to respond to reported issues within a reasonable timeframe and to resolve problems where possible.
Minor inconveniences, temporary interruptions or differences that do not materially affect the use of the accommodation do not automatically entitle the Guest to compensation.
The Guest must allow the Host reasonable access to inspect the accommodation or carry out necessary repairs, maintenance or solutions after reasonable notice, except in emergency situations.
PAYMENT DEFAULT
If payment obligations are not fulfilled according to the agreed payment terms, the Host may cancel the reservation.
The Host is entitled to make the accommodation available for other guests after cancellation.
The Host may recover statutory collection costs and interest where applicable under Dutch law if the Guest fails to pay undisputed amounts within the applicable payment period.
RIGHT OF WITHDRAWAL
The Guest acknowledges that reservations for accommodation services provided on a specific date or during a specific period are excluded from the statutory right of withdrawal under applicable consumer protection law.
By completing the booking and payment process, the Guest expressly agrees to the selected dates and applicable cancellation conditions.
DAMAGE, LOSS AND EXCESSIVE CLEANING
The Guest agrees to use the accommodation responsibly and return it in a reasonably clean and tidy condition.
The Guest is responsible for damage, loss, missing items, or excessive cleaning caused by the Guest or persons staying at or visiting the accommodation under the reservation.
The Guest is responsible for:
Damage to the accommodation, furniture, equipment, or inventory;
Missing keys, access devices, parking cards, or other property belonging to the Host;
Excessive cleaning required beyond normal recreational use;
Costs resulting from violation of this Agreement or the house rules.
The Guest is not responsible for:
Normal wear and tear resulting from ordinary use;
Defects caused by age or normal use;
Circumstances outside the Guest’s reasonable control.
Contractual Fines and Fixed Fees:
To avoid discussion regarding the calculation of damages, the Guest agrees that the following fixed contractual fines/fees shall apply immediately in the event of a breach:
Smoking Violation: Smoking (including e-cigarettes, vapes, or cannabis) inside the accommodation is strictly prohibited. Violation will result in a fixed fine of €500.00 to cover deep cleaning, air purification, and deodorization.
Unauthorized Pets: Pets are strictly prohibited unless prior written approval has been granted by the Host. Bringing an unauthorized pet will result in a fixed fine of €250.00 for deep cleaning and allergy treatment.
Lost Keys or Parking Cards: A fixed replacement fee of €50.00 shall be charged for each lost, damaged, or unreturned key, key fob, physical access badge, or parking pass.
The Host does not require a security deposit unless explicitly agreed otherwise. The absence of a security deposit does not limit the Guest’s legal responsibility or liability for damage caused during the stay.
The Host may document the condition of the accommodation before and after the stay through photographs, videos, inspection reports, or other reasonable evidence.
Payment and Credit Card Authorization:
If damage, missing items, contractual fines, or additional cleaning costs are identified during or after departure, the Host will inform the Guest within a reasonable period and provide details regarding the claim.
The Guest explicitly authorizes the Host to charge the credit card or payment method provided during the booking process via the property management platform (Hostaway) or payment processor for any undisputed or proven amounts owed under this section, including contractual fines, damage repairs, missing property, or excessive cleaning fees. Where prior authorization is not available or insufficient, the Guest agrees to pay all invoiced amounts within 14 days of receiving a written payment request.
Examples of excessive cleaning include:
Excessive dirt, rubbish, or unbagged waste left inside or around the property;
Excessive food waste or unwashed dishes left in the kitchen;
Stains on furniture, linen, or carpets requiring specialized treatment;
Smoking-related odor or cleaning;
Unauthorized pets;
Damage requiring extra cleaning or technical repair.
INTERNET AND DIGITAL SERVICES
Where internet access (Wi-Fi) or other digital services are provided, the Host will make reasonable efforts to ensure continuous availability and functionality.
The Guest acknowledges that internet services are provided by external third-party suppliers and that speed variations, network interruptions, routine maintenance, or technical failures may occur. The Host does not guarantee uninterrupted internet access, specific download/upload speeds, or suitability for high-bandwidth activities (such as remote working or heavy streaming).
Acceptable Use and Indemnification:
The internet connection provided at the accommodation may strictly be used for lawful purposes. The connection may not be used for:
Illegal activities or criminal offences;
Copyright infringement, including unlawful file-sharing, torrenting, or unauthorized downloading/uploading of copyrighted material;
Accessing, downloading, or distributing unlawful, harmful, or abusive content;
Activities that compromise the security or integrity of the network or hardware.
The Guest is fully responsible for the digital activities and internet usage of all persons staying at or visiting the accommodation during the rental period.
The Guest agrees to fully indemnify, defend, and hold harmless the Host against any and all claims, fines, liabilities, legal fees, damages, or costs arising from or related to any unlawful internet usage, copyright infringement, or cybercrime committed via the accommodation’s network during the Guest’s stay.
TEMPORARY INTERRUPTION OF SERVICES
The Guest acknowledges that temporary interruptions, breakdowns, or fluctuations of utilities or digital services may occur, including:
Electricity, gas, or water supply;
Heating or hot water systems;
Internet, Wi-Fi, television, or streaming devices;
Kitchen appliances or other electrical facilities.
The Host will make reasonable efforts to address and resolve reported issues within a reasonable timeframe once notified. However, temporary interruptions caused by third-party suppliers, utility companies, public infrastructure, weather conditions, or circumstances outside the Host’s reasonable control do not constitute a breach of this Agreement. Such interruptions do not automatically entitle the Guest to rent reductions, financial compensation, or early cancellation, except where explicitly required by mandatory law.
FORCE MAJEURE
The Host shall not be liable for failure or delay in fulfilling obligations under this Agreement where such failure results from circumstances beyond the Host’s reasonable control.
Such circumstances may include, but are not limited to:
natural disasters;
extreme weather conditions;
fire;
flooding;
government measures;
changes in laws or regulations;
utility failures;
strikes;
pandemics or public health measures;
actions of third parties;
other unforeseen circumstances beyond the Host’s reasonable control.
The Host will make reasonable efforts to inform the Guest and find an appropriate solution where possible.
If performance of the Agreement becomes impossible due to force majeure, the Host and Guest will cooperate reasonably to find a suitable solution.
The Guest remains responsible for personal circumstances, travel arrangements, illness, transport issues or other matters within the Guest’s own control unless mandatory law provides otherwise.
LIABILITY
Personal Belongings and Security:
The Guest is solely responsible for their own personal belongings, luggage, vehicles, and valuables during the stay. The Host accepts no responsibility or liability for loss, theft, damage, or destruction of personal property belonging to the Guest or their companions, regardless of the cause, except where such exclusion is prohibited by mandatory law. Guests are strongly advised to secure their own travel, personal property, and cancellation insurance.
Injury and Accidents Disclaimer:
To the maximum extent permitted by applicable mandatory law, the Host accepts no liability for any personal injury, illness, bodily harm, disability, or death suffered by the Guest, their companions, or invited visitors during their stay at the accommodation, whether occurring inside the property, on the patio, in the private garden, or on surrounding grounds and shared facilities (including but not limited to the use of play equipment, barbecues, steps, or bicycles), except in cases of proven gross negligence or willful misconduct directly attributable to the Host.
Responsibility for Companions:
The Guest making the reservation is fully responsible for the actions, omissions, negligence, and behavior of all persons staying at or visiting the accommodation under their reservation.
Limitation of Liability (Liability Cap):
The Host shall not be liable for indirect damages, consequential damages, loss of profits, loss of enjoyment, missed travel opportunities, or non-pecuniary losses under any circumstances.
To the extent that the Host is found legally liable for any direct damages under this Agreement or applicable law, the Host’s total cumulative liability shall at all times be strictly capped and limited to a maximum amount equal to the total rental fees actually paid by the Guest for the reservation in question, or the amount paid out under the Host's liability insurance policy for the claim, whichever is lower.
Suitability of Property:
The Guest acknowledges that the accommodation is a private holiday rental and that the use of facilities, amenities, equipment, and surrounding grounds involves personal responsibility. The Guest remains responsible for assessing whether the accommodation, its layouts, steps, and facilities are suitable and safe for themselves and all persons staying under their reservation, including children, elderly persons, or individuals with mobility restrictions.
PERSONAL DATA (GDPR)
The Host processes personal data of the Guest for purposes related to:
reservation management;
communication;
administration;
payment processing;
legal obligations;
fraud prevention;
municipal registration and taxation requirements.
The Host may use external service providers for reservation management, payment processing, communication and operational purposes, including property management software providers.
Where such providers process personal data on behalf of the Host, they act as processors in accordance with applicable data protection legislation.
Personal data will only be processed for legitimate purposes related to the rental agreement and will not be retained longer than necessary or legally permitted.
The Host processes personal data in accordance with the General Data Protection Regulation (GDPR) and applicable privacy legislation.
The Guest may exercise applicable rights regarding personal data stored by the Host, including rights of access, correction and deletion where applicable.
The Host will not request or retain copies of identification documents unless legally required or necessary for legitimate verification purposes.
SECURITY DEVICES
The Guest is informed and acknowledges that an outdoor security camera is located outside the accommodation for safety, security, and property protection purposes.
The outdoor camera monitors only external areas (such as the entrance, driveway, or outer perimeter). The Guest acknowledges and agrees that no video, audio, or recording devices are present inside any private indoor areas of the accommodation.
GOVERNING LAW AND DISPUTES
This Agreement is governed by Dutch law.
Any disputes relating to this Agreement shall be submitted to the competent court in the Netherlands, subject to mandatory consumer protection rules.
Nothing in this Agreement limits any mandatory rights of the Guest under applicable consumer protection law.
If any provision of this Agreement conflicts with mandatory legal provisions, the mandatory legal provisions shall prevail.
SEVERABILITY
If any provision of this Agreement is found to be invalid, unlawful or unenforceable, the remaining provisions shall remain fully valid and enforceable.
The parties shall replace the affected provision with a valid provision that most closely reflects the original intention.
FINAL ACCEPTANCE
By completing the booking process and making payment, the Guest confirms that:
this Short-Term Holiday Rental Agreement and House Rules were made available before booking;
the accommodation details, rental period, price and cancellation conditions were available before completing the reservation;
the Guest accepts this Agreement as part of the rental agreement;
the Guest accepts responsibility for ensuring that all persons staying at the accommodation comply with these terms.
The booking confirmation, this Agreement, the applicable cancellation policy and the house rules together form the complete agreement between Host and Guest.
